Moriarty and Hutchison Bill to Regulate Sober Living Homes Takes Effect

Earlier this year, Senator Moriarty and Assemblyman Hutchison met with constituents who expressed the lack of regulation and oversight of sober living homes. Shortly after, they introduced a bill (S2952/A4535), now law, to regulate sober-living homes. This law recently took effect, now requiring sober-living homes to undergo unannounced state inspections twice a year, adhere to stricter reporting requirements, and face stiffer fines for any violations.


This new law is to ensure a safer environment for both residents and neighbors. Key requirements include:

  • Qualified on-site staff: All sober-living homes must have trained, responsible personnel available at all times.

  • Random testing: Residents are subject to random drug tests and breathalyzer checks to maintain a substance-free environment.

  • Counseling: Homes are encouraged to provide counseling and peer-led meetings.

  • Zero tolerance policy: Any possession or use of alcohol or illegal drugs is strictly prohibited.

  • State oversight: Homes will face unannounced inspections twice a year to ensure compliance and protect residents.
